eviction/credit problem?

When I was around 12, me & my family moved into a house under a mortgage & around 2010 (I was not around anymore, lived with friends) they lost the house (foreclosed/evicted)

I moved out around 2009 when I turned 18 yet my question –

Now, I am 20 & live with roommates & we found a new house to rent out.

Everything went fine until we turned in our applications. Went through a a background/credit check & found a eviction/judgement under my
name. I had no clue at all that this could have ended up on my name as I didn’t pay rent nor sign anything at the time and moved out without knowing about the eviction.

Now, I cannot move out nor apply for a credit card because of this following me.
The RA agent suggested – obtain my records @ the courthouse & get an attorney yet it can be costly.

Is there any other way ? Am I in the wrong ?
I have no clue in where to start.

You can contact the DA. If they get a conviction for identity theft you can clean it up for cheap, but not until your father is serving time. (or whoever used your ID)

Nope, we both (father) have different names

Do you have the same name as your father?

If not, the only way this would have found its way onto your report is if your parents used your name and ssn# to rent this place out..

broken lease on old apartment ???

Im applying at an apartment today but im nervous i will get denied , i had an apartment over two years ago and i only lived there for 3 months ……… i had to move because my apartment was broken into twice during the time i lived there, the management wouldnt do anything for me even though I knew it was the neighbors doing it….. they knew when i would leave for work and when i would get home….
i asked the management to switch me units , i asked them to get more police to watch the place ………. nothing and to make it worse iw as 4 months pregnant at the time, i ended up finding a landlord willing to lease a house to me so i moved into the house and i have been here for 2 years, my lease is almost up and my landlord is saying that my rent is going to go up because of his mortgage rates so I want to move into a less expensive place, my rent has been paid on time every month since i moved in here ……….. but i cant afford to lose application fee after application fee trying to find a place to live…….. on top of that i have a misdeamenor charge for a bounced check ……. this shouldnt even be on my record since I paid it back and all charges were dismissed……. i just haven paid to get it expunged off my record………

If anyone knows anything about leasing agents and apartment leasing please let me know what i can do and if there is a chance i can get into a property.

If you owe an apartment money, or have an eviction, it is very likely that you will not be approved at a corporate-owned apartment complex.

You need to make things right with the check and the old apartment complex, then try to find a place to live.

I need advice on suing BoA?

i received a letter in the mail that they reviewed my account and were lowering my mortgage payment. i called to confirm and they did and said the papers for me to sign we on the way. i wans NOT behind in my payments btw. got Bill with new amount shown and paid. after 10 months and dozens and dozens of calls to them i still did note have the papers they refetenced. they toold me to keep making the lower payment. well after those 10 months i received a letter saying my application was denied.. .WHAT application? anyhow they stated foreclosure letters, ruined my credit and i had to pay them TEN GRAND to get my account current!! what can i do?? they said its their policy to do that to everyone and then check later if the customer “qualifies “. Again, i neither applied for nor signed anything!

Kemperk, this is definitely not a hoax. I have a pile of paperwork, letters from bank of america and records of the dozens of phone calls I made. Believe me I wish this was fake. My mortgage is up to date now, but still I had to pay bank of America close to $10,000 in order to bring the account current. My credit is ruined because of this. I’ve been doing research before I go see an attorney to see if this is something I should pursue. I don’t feel like wasting time and money if this is some normal practice for these mortgage companies….
Noodle, i’m not looking for free help. I’m financial capable of hiring an attorney. However, I’m not going to waste my time and money if Bank of America is “allowed” to run a scam like this. I’m looking to see if anyone else had a similar situation and what was done. If anyone has any TRUE legal knowledge can tell me if this is a ‘deceptive business practice’. Thanks anyway….

You ask for advice on suing BoA. My advice is of course to contact an attorney. It could be a letter from an attorney would solve everything.

However there is a story I saw on TV news about some people that were mistreated by BoA and won a judgment in court and BoA never paid them. So the people filed a lien and still didn’t get paid. SO the people foreclosed on the local branch building of BoA. That finally got their attention and got the settlement plus legal fees and such. I have link for story below.

Loan modification hardship letter?

I’m writing a hardship letter to our mortgage lender. My husband and I are not behind yet, but most likely will be soon. My hours have been cut at work and there’s no indication that I’ll be working more any time soon. We live in the one of the nations worst hit counties in NV for unemployment, so finding more work is a slim proposition. Our electricity bills were double for the months of Aug/Sept/Oct and that completely drained our meager savings. We are barely squeaking by pay check to pay check.

Selling our home is out of the question (this is what we’d do in a normal market) but our house is 167% underwater. We figure loan modification is our next step, but are worried that since we haven’t actually missed a payment yet, we will be overlooked. We’ve inquired 2 times over the last 3 months to have the application sent, but still nothing. To top things off, we know I will miss at least 3 months of work due to an unexpected/miracle pregnancy. Does that count? I now divorce/separation does, those are ‘life choices’ and I heard that pregnancy didn’t apply since it was a ‘life choice’. Some of us can’t simply kill our unborn fetus due to the fact that we are having a hard time at the moment. (ok, don’t dwell on that topic to much, ok?)

Anyway, any help, advice from those already gone through this process, etc. would be greatly appreciated.

I am not trying to get more money so I can be a stay at home mother. I have 2 other children and currently work. I do know for a fact that my employer does not offer maternity pay and how many women do you know that can deliver vaginally and be up for work the week later? Yeah, not many!

You likely will not be able to modify your loan until after a default has been filed against you. The modifications are to help prevent a foreclosure, not provide more income so you can be a stay at home mother.
